EU Adoption of EU-US Data Privacy Framework

by Leela|27 July 2023|Our Thinking

On 10 July 2023, the European Commission adopted the new EU-US Data Privacy Framework (the “Framework”). This Framework ensures that personal data transferred from entities in the EU to entities in the US who are signatories to the Framework will receive adequate protection. As a result, personal data can freely flow from the EU to these US entities without the need for additional data protection safeguards.

The previous EU-US Privacy Shield framework, which allowed data transfers without extra safeguards, was invalidated by the Court of Justice of the European Union in 2020 due to concerns about…

US surveillance practices. This decision had significant implications, requiring organisations to reevaluate their data transfer practices and implement alternative mechanisms to ensure secure data transfers to the US.

We have created a concise one-page guide that outlines the main aspects of the EU-US Data Privacy Framework and its implications for companies in the EU and the US.
